Welcome to the Masarrah App
Global Shaleehat Company LLC in the Sultanate of Oman provides the Masarrah App which operates as an intermediary electronic platform between Hosts who own properties and Guests wishing to rent them We provide online booking services through the App in accordance with the following terms and conditions

First Definitions
In this Agreement unless the context otherwise requires the following terms shall have the meanings assigned to them below
App or we or us or our refers to the Masarrah App and Global Shaleehat Company LLC in the Sultanate of Oman holding Commercial Registration Number 1344621
User or you or your refers to any person who visits or uses the App in any manner whether as a Host Guest or otherwise
Host refers to any natural or juristic person who registers on the App for the purpose of listing establishments for rent for a certain period through the App and also refers to any person authorized by the Host or deemed as such
Guest refers to any natural or juristic person who registers on the App for the purpose of renting the Host establishment in accordance with the agreement concluded through the App and also refers to any person authorized by the Guest or deemed as such
Service refers to the service of booking the Host establishment online through the App
Establishment means all units or places displayed through the App for booking or rental purposes including but not limited to rest houses chalets hotel apartments villas hotels furnished apartments caravans yachts wedding halls seating areas and camps
Establishment Policy refers to the set of terms and instructions placed by the Host under one policy that is announced to the Guest before submitting a booking request and which includes all provisions relating to the use of the Establishment and the cancellation or amendment of bookings
Agreement refers to this document including its terms and conditions the Privacy Policy all other agreements between the App on the one hand and any of its Users on the other hand as well as all instructions and orders issued by the App to any of its Users
Laws refers to the laws applicable in the Sultanate of Oman
Second Our Services
1 The App provides Guests with services for browsing Establishments available for booking through the App and requesting to rent them electronically through the App in accordance with the terms and conditions of this Agreement
2 The App provides electronic payment services and payment methods suitable for all our Users in accordance with the payment policy adopted under this Agreement
3 We provide App services to all Guests from inside or outside the Sultanate of Oman The App aims to provide a distinguished experience to all Guests
Third Legal Scope of the Agreement
1 This Agreement has been prepared by the Masarrah App and is presented through the App for full acceptance without excluding any provisions or rejecting it in its current form If the User does not agree to any of its provisions the User must refrain from using the App or benefiting from its services This Agreement includes all terms and provisions that govern the legal relationship between the App on the one hand and the App Users on the other
2 You acknowledge that this Agreement constitutes a complete electronic contract with all required terms and elements It has been prepared and drafted in accordance with the applicable laws and is intended to be accepted and approved electronically It shall produce all its legal effects once accepted and approved in accordance with the provisions of this Agreement
3 You acknowledge that all legal effects arising from this Agreement shall be effective against all App Users No User may evade their obligations in any manner deny the Agreement or claim rejection of it in contravention of its provisions within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
4 You acknowledge that this Agreement constitutes the entire agreement between you and the App and supersedes all previous agreements whether oral or written except for written contracts and agreements that expressly state that they are complementary to this Agreement
5 All contracts concluded between the App on the one hand and any App User on the other hand shall form an integral part of this Agreement If any term of such contract conflicts with any term of this Agreement the terms of the contract shall apply as a special agreement between the parties
6 You acknowledge and agree that this Agreement is subject to continuous updates to ensure the optimal regulation of the legal relationship between the App and its Users and that such amendments and updates shall have the same binding legal force as this Agreement
7 The App may apply the provisions of this Agreement to all its products and platforms
Fourth Mandatory Contracting Conditions
For contracting with App Users to be accepted the following mandatory conditions must be met
1 The User must be 18 years of age or older and must not be affected by any incapacity such as prodigality insanity mental deficiency or lack of discernment in accordance with Article 41 of the Omani Civil Transactions Law Persons under the age of 18 may not register an account or make any booking or payment through the App If a minor wishes to benefit from the services the booking payment and conclusion of this Agreement must be carried out by a parent or legal guardian who has full legal capacity and in the name of that parent or legal guardian who alone shall bear full legal responsibility for use of the Service
2 The User must have full legal capacity to benefit from the App services and enter into this Agreement with us and must not be affected by any incapacity such as prodigality insanity mental deficiency or lack of discernment
3 The User must have full authority to enter into this Agreement with us Either the User represents themselves and provides services or benefits from the services of others for personal interest or the User represents another person In such case the User must have a legal power of attorney authorizing the User to bind the principal to the registration process on the App
4 If registration is made on behalf of a juristic entity such as an establishment or company the User must have legal capacity as the legal representative of that juristic entity based on the commercial registration or a legal power of attorney issued by a governmental authority
5 Acceptance of contracting with the User requires final approval of the terms and conditions and the Privacy Policy after reviewing all their provisions
Fifth Electronic Signature
1 Your use of the App registration of your account through it listing of services through it requesting to benefit from the services provided by the App or using the App in any manner shall constitute final acceptance of this Agreement and an electronic signature on it
2 You acknowledge that your electronic signature under paragraph 1 replaces any handwritten signature required on this Agreement and constitutes final approval of the electronic contracting system provided by the App for accepting the contract with the User and implementing the provisions of this Agreement
Sixth Guest Membership Registration
1 The App allows the Guest to register a membership through which the Guest may browse the services of all Hosts submit Establishment booking requests make electronic payments through the App and track requests submitted through the App
2 Guest membership registration on the App requires completing the account registration form through the App and providing us with the following data name phone number email address digital identity identity card or passport
3 Membership registration data on the App must be true accurate and lawful The Guest must be legally authorized to provide such data through the App and must ensure that this remains the case throughout the period of registration with us on the App
4 Membership registration on the App is personal in nature This means that you may not claim that you registered on behalf of another person unless you provide us with legal authorization during registration You may not assign your account to any other persons or entities or use any other User account without obtaining our written approval
5 The Guest undertakes not to register more than one account on the App If we discover otherwise we will delete the other account and issue a notice If repeated all accounts belonging to the Guest will be cancelled
6 The Guest shall be fully responsible for all transactions and operations carried out through the Guest account on the App
7 The App may close your account temporarily or permanently if you breach any of the terms and conditions of this Agreement infringe any of our rights or the rights of others or violate any applicable laws
8 The App may delete inactive memberships or memberships that have not been fully activated without requiring notice to the account holder
9 The account on the App is provided under a license to use and not ownership Accordingly the App may at any time withdraw the license granted to the Guest and close the membership if the Guest breaches the terms of this Agreement or for any reason the App deems appropriate
10 The Guest undertakes to maintain the confidentiality of the login details and password of the account and not to disclose them to others or allow any person to use the account The Guest shall be liable for everything carried out through the account The App may verify the Guest identity by any means it deems appropriate before or after completion of the booking and the Guest must cooperate in this regard to ensure transaction security and prevent fraud
Seventh Establishment Listing Policy
1 The Host provides the policy and terms of use of the Establishment called the Establishment Policy This policy governs the legal relationship between the Host and the Guest These policies shall apply alongside this Agreement provided that they are announced before booking on the listing page The policy displayed in the listing shall apply If any amendments are made after the booking the Host shall remain bound by the announced policy that the Guest expressly accepted before the listing
2 The Host provides the prices for the rental period for example the daily rental price or weekly rental price and so on These prices shall be clear to the customer Payment shall be made through the App based on these prices and such prices shall be binding on both parties after the booking process
3 The Masarrah App may display the approximate location of the Establishment within the listing provided that the actual and precise location is shown only after the booking is completed
Eighth Guest Terms and Conditions
1 The Guest shall be the first and final person responsible for the account linked to the data provided to us during registration or at any time The Guest shall be liable for any unlawful or unauthorized use carried out through the account on the App
2 The Guest provides us with all personal data such as name and personal information under the Guest personal responsibility Accordingly the Guest shall bear full legal responsibility if such data is false misleading forged or otherwise
3 The Guest shall comply with all booking requests submitted through the App and guarantees that such requests are serious and not fictitious The Guest also guarantees not to submit any requests intended to disturb the App or Hosts
4 The Guest acknowledges that the Host may request documents to complete entry procedures to the Establishment such as an identity card or passport The Guest shall provide them in accordance with the Host requirements without any liability on the App
5 The Guest shall use the Establishment for lawful purposes and is prohibited from using such places for any acts contrary to public morals or any other unlawful acts
6 The Guest shall preserve the place and shall not cause any damage to it or distort it in any manner The Guest shall also not cause any damage to the movable items available inside the place
7 The Guest is prohibited from subleasing the Establishment unless the Host Establishment Policy permits it In such case the operation shall be carried out under the responsibility of the parties
8 The Guest acknowledges and agrees that the App shares the Guest name phone number booking date and booking amount with the Establishment owner through the App as entered into the App
9 The Guest acknowledges that the services received through the App are provided by the Host without any intervention from the Masarrah App Accordingly the Guest releases us from any liability arising from the provision of such services
10 The Guest shall pay the value of the services provided in accordance with our payment policy The Guest acknowledges that the App is responsible only for amounts paid through it Accordingly any amounts paid by the Guest directly to the Host shall be under the Guest personal responsibility without any liability on the App
11 If the Host requests a security deposit before handing over the Establishment the value of the security deposit and the conditions for entitlement to it or its refund must be disclosed in the Establishment Policy before completion of the booking The receipt and refund of the security deposit shall take place directly between the Host and the Guest and outside the App payment systems The App shall not be a party to receiving holding or refunding that amount and does not provide any guarantees or undertakings in relation to it This shall be the sole responsibility of the Host and the Guest
12 The Guest acknowledges that our role is only that of an electronic intermediary to facilitate the booking process and that the Establishments belong entirely to the Host who is responsible for them and their legality The Guest shall notify us within 24 hours from the booking date of any issue encountered The Guest acknowledges that after this time the App will transfer the booking amounts to the Host
13 The Guest acknowledges that the Guest receives information from the Host under the Guest personal responsibility without any liability on the Masarrah App
14 The Guest shall ensure that the review of the service provided by the Host is truthful and reflects reality and does not include any abuse or obscene language The criticism or review must remain within the limits permitted by law
15 If the Host requests a deposit before handing over the Establishment the receipt and delivery of this amount shall be agreed between the Host and the Guest outside the scope of the Masarrah App The Masarrah App does not provide any guarantees regarding receipt of this amount and this shall be under the responsibility of the parties
16 The Guest acknowledges that we are not employers and that we are not an entity that owns rest houses and that we do not have any regulatory or supervisory authority over the Host The Hosts are fully independent in their work
17 The Guest acknowledges that we do not represent the Guest before third parties and are not deemed an agent of the Guest The Guest shall be personally liable towards the Host in the event of breach of the terms and conditions set out in this Agreement or in the event of breach of the legal provisions and rules in force within the Sultanate of Oman
18 If the Guest changes any data registered with us on the App the Guest shall immediately notify us of the correct and updated data
19 The Guest shall not contact the Host or request services from the Host outside the framework applied inside the App If the Guest breaches this obligation the App may suspend the Guest permanently or temporarily while preserving all our other legal rights
20 The Guest shall not defame the Masarrah App in any manner or abuse us physically or electronically In the event of any issue relating to use of the App the Guest shall notify us immediately and we will provide assistance to resolve the issue
21 In all cases the Guest shall comply with all laws and regulations applicable in the Sultanate of Oman whether the Guest is a citizen or a foreigner
22 The Guest shall not exceed the maximum number of persons permitted and announced on the Establishment page The Guest shall also comply with all Establishment rules announced before booking including check in and check out times smoking rules rules on pets holding parties or events and the number of companions The Guest alone shall bear full responsibility for themselves and all companions and visitors during the stay and for any damage caused to the Establishment or its contents
23 The Guest shall treat the Host and the Host staff with respect and is prohibited from any discriminatory or abusive conduct based on gender nationality race religion disability or any other grounds The App may suspend the Guest account temporarily or permanently if this obligation is breached without prejudice to any other legal rights of the Host or the App
Ninth Booking and Cancellation Policy
1 The Guest may view Establishments available for booking on the App and their prices then submit an electronic booking request through the App and confirm the request through payment using our approved payment methods Bookings on the Masarrah App are subject to two systems
First Host enabled instant electronic booking If available the Guest booking is made directly upon booking the available Establishment
Second Host enabled non instant electronic booking In this case the Host shall confirm or cancel the booking within the period specified by the Establishment owner After the booking is confirmed by the Host the Guest shall pay the booking fees within the period specified by the Establishment owner or the booking shall be cancelled automatically or manually by the owner of the Masarrah App
2 The booking request submitted through the App shall include the place name booking duration total booking cost check in time and check out time
3 The Host shall display the Establishment Policy regarding booking amendment or cancellation This policy must be completely clear to the Guest The Guest shall review the policy and inquire about it if it is unclear or if the Guest has not reviewed it before booking Submission of the booking request shall constitute final approval by the Guest of the terms of that policy
4 The booking date may be amended in accordance with the App policies and the Establishment Policy applicable at the time of the amendment request Any amendment shall be subject to the approval of the other party and availability of the requested dates The amendment may also result in price differences or fees according to the prices applicable at the time of amendment
5 Acceptance or rejection of a booking date amendment request depends on the Host or Establishment owner in accordance with the Establishment booking policy The App shall not bear any liability for this
6 The Guest may request to amend the booking date provided that the request is submitted at least 24 hours before the booking date The amendment may not be made more than twice and any amendment shall be subject to the Host approval and availability of alternative dates
7 If any price difference arises from amending the booking date the Guest shall pay such difference before the amendment is confirmed
8 If the property owner and the Guest agree on cancellation the customer service team must be notified if the property policy does not allow cancellation of the booking
9 The Masarrah App may without obligation intervene and coordinate between the Guest and the Host to consider amendment or cancellation requests
10 The Masarrah App shall deduct a service fee of 2.2 percent of the booking amount The party causing the cancellation shall bear this fee and it shall be deducted directly without notice The service fees may change from time to time and the party causing the cancellation shall bear them regardless of their percentage
11 Where the Host accepts the booking and fails to hand over the place to the Guest in accordance with the agreement concluded through the App and fails to cancel the request in accordance with the cancellation policy the Host shall in such cases pay the full booking amount as compensation to the Guest
12 If the Host and Guest agree to amend booking dates this agreement must be recorded in the booking request submitted through the App and the previously agreed check in and check out times must be amended
13 If a dispute arises between the Host and the Guest regarding the interpretation of certain provisions of the Establishment Policy the App may for the purposes of managing the booking inside the platform interpret the Establishment Policy and take an operational decision regarding the booking amount such as refunding the amount to the Guest or taking any other action the App deems appropriate without prejudice to the right of any party to resort to the competent judicial authorities
14 The Guest shall immediately notify the customer service team through the App of any dispute or issue with the Host within a maximum of 5 days The App shall not bear any liability for any rights or compensation that the Guest may lose as a result of late reporting since the App transfers the booking amount to the Host after the booking period ends and it may become difficult to recover the amount in the event of late reporting
15 In emergency events calamities public disasters and wars such as infectious diseases natural disasters or binding governmental orders including for example coronavirus and others the App reserves the right to cancel bookings and refund amounts to Guests Hosts and Guests shall not have the right to file any legal claims against the App and the parties expressly release us from liability in such case The App may deduct electronic payment service fees bank transfer fees and service fees
16 Neither party shall be liable for failure to perform its obligations if such failure results from force majeure or causes beyond its control provided that such cases shall be handled in accordance with the policies approved by the App
17 The User acknowledges that the policies procedures and operational protocols approved by the App including booking cancellation payment refund and fine policies form an integral part of this Agreement and the User shall be bound by them once they are published or updated through the App
Tenth Payment Policy
1 The Masarrah App accepts payment through the following methods Visa MasterCard and bank transfer to the company account Payment shall be made in Omani Rial or any other currency accepted by us
2 The App provides a pay on arrival service for some bookings whereby the Guest completes the booking through the App and undertakes to pay the booking value upon arrival at the Establishment Completion of the booking through the App shall constitute a binding obligation on the Guest and the Host may take the necessary procedures in the event of failure to pay For bookings made under the pay on arrival system the Guest shall attend at the specified time and pay the booking value directly to the Host in accordance with the booking terms displayed through the App The Host shall specify in the listing or booking terms of the rented place the period after which the Guest is deemed to have failed to show up The Guest shall review such terms before completing the booking If the Guest fails to show up according to the specified period the Host may cancel the booking and make the date available for booking by other Users The Host may also claim any no show fees or compensation that are announced to the Guest before completion of the booking The Host shall collect the booking value from the Guest upon arrival and shall pay the App commission due in accordance with the agreement concluded with the Host and the applicable App policies The App entitlement to collect commission in cases of no show or booking cancellation shall be determined in accordance with the policies announced by the App For purposes of verification and proving whether the booking was performed or not performed the App may rely on its electronic records booking data communication records between the parties and any other documents or digital evidence it deems appropriate These records shall be deemed valid evidence unless proven otherwise
3 Bank fees may be imposed on electronic payments or bank transfers In such case the Guest shall bear all fees imposed on money transfers through the payment methods approved by us
4 The Guest agrees to store payment card data with the licensed electronic payment service provider and authorizes the App to automatically deduct the booking value upon acceptance of the booking by the Host or when making a new booking without the need to re enter the data The Guest shall cancel the booking request before Host approval to avoid deduction and acknowledges the App right to do so
5 Government taxes may be imposed on rental and usufruct transactions obtained by the Guest In such case the Guest shall pay any government taxes related to the Guest use of the places requested for rent through the App
6 If a dispute arises between the Host and the Guest the Guest shall notify us within 24 hours from the start of the booking date otherwise the full booking amount will be paid to the Host
7 The Masarrah App shall not be responsible in any manner for any amounts paid directly to the Host or any amounts generally paid outside the App The Guest acknowledges that the App is not responsible for them and acknowledges that we provide no guarantees regarding them and that we will not be able to recover any such amounts again
8 The Guest must fully verify the payment process carried out through the App The App shall not bear any legal liability in the event of error in the payment process or bank transfer We also disclaim legal liability for any hacking of the Guest payment methods
9 The Masarrah App allows some Users to pay the booking value through installment payment services provided by external programs such as QPay and Tasheel in accordance with the terms and conditions of each program The Guest acknowledges that any obligation or agreement relating to the installment service is between the Guest and the service provider only and the Masarrah App shall not bear any liability in this regard
10 You acknowledge that the payment policy adopted by us may change from time to time We may add new payment methods or cancel other payment methods without requiring the approval of any App User Accordingly you must review the payment policy each time you make a payment through the App
11 The booking value may be subject to value added tax and any tourist or municipal fees prescribed under the laws applicable in the Sultanate of Oman Such taxes and fees shall be shown to the Guest within the total amount before completion of the payment process
Eleventh Content Policy
1 The Masarrah App provides its own content through the App pages and retains all intellectual property and commercial rights over such content Misuse of this content in any manner is prohibited It is intended only for our services and it is prohibited to copy modify imitate quote or carry out any work on the content without obtaining our written approval
2 The Masarrah App allows its Users to provide content through the App Such content is provided under the User full responsibility The User represents that the content is lawful and does not infringe any intellectual property rights or personal rights of third parties The User shall bear full legal responsibility towards rights holders in the event of breach of any of their rights
3 If notices are submitted to the Masarrah App stating that User provided content infringes any third party right the App will delete such content so that the App is not exposed to any legal claims
4 The Masarrah App may access and monitor all messages conversations and chats conducted through the App and may access any content exchanged between Hosts and Guests The App processes Users data in accordance with the Privacy Policy published inside the App and for the purposes of account creation booking execution payment technical support legal compliance and fraud prevention User data shall not be used for direct marketing purposes except as permitted by applicable laws and in a manner that allows the User to unsubscribe whenever possible
5 Users are prohibited from sharing any external means of communication including phone number email address or any other means through in app conversations before completion of the booking
6 The Masarrah App may display any feedback or opinions of Guests on our platform after booking Establishments and Hosts and Guests shall not have the right to object to the same
7 The App processes the Guest personal data in accordance with the Privacy Policy published inside the App and in compliance with the Personal Data Protection Law issued by Royal Decree Number 6 of 2022 its Executive Regulations and the laws in force in the Sultanate of Oman The Guest acknowledges having the rights prescribed under this law including the right to access correct and request deletion of the Guest data and withdraw consent to processing within the limits permitted by law In the event of any personal data breach the App shall take the legally prescribed measures including notification as required by the applicable regulations
Twelfth Reviews Policy
1 The Guest may add reviews on booking transactions and services received from the Host Such reviews must be truthful objective and reflect the performance of the service whether negative or positive We advise the Guest to contact the Host to resolve any dispute before adding a negative review
2 It is prohibited to use any offensive words or expressions political slogans expressions that violate applicable laws or include abuse of cultures peoples or nations racism or anything that violates public order and morals
3 It is prohibited to use the review service for the purpose of publishing contact methods links software promoting any goods or services or carrying out any acts that conflict with the review of the service
4 The App reserves the right to delete any reviews that do not comply with the preceding provisions or that conflict with the provisions of this Agreement
5 The App disclaims legal liability for all unlawful reviews or reviews that include abuse of any party The author of the review shall bear full legal responsibility
Thirteenth Copyrights
1 The App and the ideas expressed within it are our exclusive intellectual property rights Any imitation or quotation of the App or some of its services including ideas texts codes and software shall constitute an infringement of our copyrights and we will take all legal measures against the perpetrators of such infringements
2 All content included or made available within the services of the Masarrah App such as texts logos images graphics audio recordings button icons digital content re uploaded materials software and data compilations belongs to the Masarrah App and is protected by the laws applicable in the Sultanate of Oman and international copyright laws
3 The compilation of all data included in or made available through the Masarrah service by any of our services is exclusive property of the Masarrah App and is protected under Omani and international copyright laws as well as applicable international conventions such as the Berne Convention and the TRIPS Agreement
Fourteenth Trademarks
1 Masarrah and the logos associated with it are our trademarks or service marks Photos logos page headers button icons texts and service names are also trademarks and trade dress belonging to the Masarrah App
2 It is prohibited to reproduce the trademarks or trade dress of the Masarrah App in any media or advertising outlet without our written permission The trademarks and trade dress of the Masarrah App may not be used in connection with any product or service that is not affiliated with us so as not to undermine the value and credibility of the Masarrah App or harm its customers
Fifteenth Licenses Granted
1 We provide the Masarrah App under a license to use By complying with the provisions of this Agreement or any terms of service and by paying any applicable fees the App grants you a limited non exclusive non transferable and non sublicensable license to access and use the services of the Masarrah App for non commercial use
2 The User is prohibited from exploiting the App for any research purpose resale or any commercial use of any of our services or content The User is also prohibited from copying information available on the App or in the User account on the App and exploiting it for personal purposes or making it available to third parties The use of data mining tools or similar data collection and extraction tools is also prohibited
3 Any User is prohibited from reproducing or making an identical copy of this App copying selling or reselling any part of it or using it in a different manner for commercial or non commercial exploitation without obtaining express written approval from the Masarrah App
4 Any User is prohibited from using any meta tags or any other text that exploits the name of the Masarrah App or its trademarks without express written approval from the App whether such use is physical or electronic
5 We provide you with a license to use only for purposes of using our services in a lawful manner and in accordance with the terms of this Agreement The licenses granted by us shall terminate if you fail to comply with the terms of this Agreement or any other terms of service
7 All rights not expressly granted to you in this Agreement or any other terms of service are reserved by the Masarrah App and you shall not be permitted to use them Their use requires written approval from the App
8 The App may block any User Host or Guest in the event of breach of this Agreement or any applicable laws or in the event of defamation of the App or abuse against it in any manner
Sixteenth Use Policy
1 The User may use the App and all services available through it after expressly accepting the terms and conditions and Privacy Policy Such use shall be conclusive evidence of that acceptance
2 The App services are available in the Sultanate of Oman and you acknowledge and agree that you are bound by all laws applicable in the Sultanate of Oman and the terms and conditions set out in this Agreement regardless of the country to which you belong the country from which you access the App or the country in which you receive the App services
3 The User undertakes to ensure accuracy when entering information required in the App and shall be responsible for reviewing such information periodically for the purpose of correcting amending or updating it whenever new information becomes available and shall retain all data and documents evidencing the same
4 All information you disclose must be true updated correct representative of you and consistent with what is required in our registration form If you provide information that is incorrect inaccurate outdated or incomplete or if we have reasonable grounds to suspect that such information is incorrect inaccurate outdated incomplete or inconsistent with this Terms of Use Agreement then without prejudice to any other rights under this Agreement or the law we will suspend or cancel your membership
5 The User undertakes to maintain the confidentiality of account information such as username and password and shall be responsible for any disclosure of such information to third parties The User shall also be responsible for any use by any person to whom the User disclosed such confidential information
6 The User undertakes to notify the App immediately in the event of account hacking theft or discovery of any unlawful use of the User account on the App so that we can take the necessary technical measures to protect the account
7 The User shall notify us if the User discovers any unlawful use of the App in order to preserve the security of the App and the transactions conducted through it
8 It is prohibited to use any service or technology through the App unlawfully The User shall use our services only for the purposes stated in this Agreement
9 It is prohibited to send any unlawful messages or messages for dating purposes or external communication purposes and the App will delete this type of messages
10 As a User you are prohibited from posting any links to other apps or websites inside the App or links that contain malicious software viruses or are intended for any fraudulent operation or any cyber hacking operations
11 You are prohibited from interfering in any manner with the operation of the App or its workflow or from declaring in any manner that you represent us contrary to truth and reality
12 The User acknowledges that by agreeing to enter into this Agreement the User shall not rely on any representations warranties or confirmations other than those set out in this Agreement whether made by or on behalf of the Masarrah App
13 Use of the Masarrah App may be associated with the provision of third party services or content which are not under our control Accordingly you acknowledge that other terms and conditions and privacy policies may apply to your use of third party services and content The Masarrah App may include or be linked to services content or websites provided by third parties that are not under the control of the App The User acknowledges that use of such services or content may be subject to independent terms and conditions and privacy policies issued by their providers and the App shall not bear any liability for such services content or their practices
Seventeenth Legal Liability
1 You expressly agree that you use the Masarrah App at your personal responsibility You acknowledge and agree that the Masarrah App is an intermediary between the Host and the Guest and does not bear any disputes or legal consequences that may arise between the Host and the Guest Each party may take appropriate legal action against the other party without recourse to us in any manner within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
2 You shall use the App seriously and honestly and shall be liable to compensate for any losses or damages suffered by the App as a result of any unlawful use or use unauthorized by us
3 The User provides us with the User data through the App under the User personal responsibility Accordingly the User shall bear civil and criminal liability if such data is incorrect incomplete inaccurate forged or non conforming in any manner
4 You acknowledge your full legal responsibility if you breach any provisions set out in this Agreement In the event of such breach we may take all measures against you including suspending or cancelling your membership or resorting to the courts
5 You acknowledge your full legal responsibility if you use the Masarrah App or any service provided through it in an unlawful fraudulent or anti social manner as we determine or if you send any messages involving racial discrimination insult defamation obscene language indecent or immoral images or content generally deemed inappropriate
6 Each of the Guest and the Host shall be personally liable for all errors and unlawful activities that occur during the performance of the Service without recourse to the App under any circumstances The relationship between the Guest and the Host is contractual Accordingly each party shall perform its contractual obligations and if either party breaches them the other party may seek recourse against that party in accordance with the applicable laws without recourse to us under any circumstances within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
7 The injured party that suffers damage as a result of any party breach of this Agreement shall take all necessary legal measures against the perpetrator of the unlawful act without recourse to us or against us The injured party shall notify us of the violation only so that internal App action may be taken such as suspending or permanently banning the membership within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
8 The penalties imposed by the Masarrah App on the parties to this Agreement shall not affect the right of each party to take any legal measures it deems appropriate at its discretion without recourse to us in any manner and without any liability on the App within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
9 You agree to indemnify release and defend the Masarrah App against all lawsuits and claims that may be brought or asserted by third parties as a result of your use of the App your violation of these terms and provisions or your breach of the rights of other Users within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
10 The Masarrah App does not guarantee that it will take action against every violation that may occur under this Terms of Use Agreement Our failure to take legal action in any case of violation shall not be deemed a waiver of our right to take such action at any time we deem appropriate
11 You must comply with all laws and regulations applicable within the Sultanate of Oman and you shall bear all liabilities arising if you breach such laws or regulations You shall also comply with all terms and conditions set out in this Agreement
Eighteenth Legal Scope of Our Services
1 The Masarrah App operates as an intermediary electronic platform that enables electronic booking only The App shall not be described as a Host or a Guest We do not own any of the Establishments available on the App nor do we request to rent them for ourselves The listing is made by the Host and the rental by the Guest Our role is limited to connecting the parties and facilitating the online booking process
2 The Masarrah App shall not be deemed an agent or legal representative of any of the parties to this Agreement whether Hosts or Guests Each person represents themselves through the App
3 The content available through the App is intended for our informational and advertising purposes and is inseparably linked to our services It may not be used or relied upon for any purpose other than the purpose for which it is intended
4 All Users whether Hosts or Guests acknowledge that they use the App at their personal responsibility and without any legal liability on the App whether civil consequential joint or criminal The App shall not accept any legal liability arising from the fault of a third party within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
Nineteenth Disclaimer of Liability
1 We provide our services as available without any representations or warranties of any kind whether express or implied relating to the use of this App its content or the services provided on it
2 There may be delays in obtaining data or partial or total loss of such data and the Masarrah App shall not be responsible in any manner for loss of data or delay in obtaining it within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
3 The Masarrah App shall not bear any legal liability if the App stops for technical legal cyber hacking or any other voluntary or involuntary reasons provided that such reasons are beyond our control within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
4 The Masarrah App shall not bear any legal liability in the event of hacking of the App any breach thereof or leakage of User data as a result within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
5 The Masarrah App shall not bear any legal liability if the User uses any photos information materials or other rights protected by intellectual property rights in the App
6 The Masarrah App shall not bear any legal liability if the User provides any forged false untrue misleading or other data
7 The Masarrah App shall not bear any legal liability if the Host fails to hand over the Establishment to the Guest or if the Host closes the Establishment or changes the activity despite existing bookings In such case the Guest may seek compensation from the Host
8 The App shall not in all cases be liable for any direct indirect or consequential loss loss of profits or goodwill or any damage whatsoever resulting from disclosure of your username or password The Masarrah App shall also not be legally responsible for losses or damages of any kind that may arise from use of this App including but not limited to direct and indirect damages within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
9 The Masarrah App does not provide any warranties that this App its servers or messages sent are free from viruses or other harmful components You acknowledge that the Masarrah App is an internet based service and although we make every effort to keep information secure we cannot guarantee that the information received or transmitted by the User while using the App will be secure at all times within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
10 The Masarrah App provides no warranty and assumes no liability regarding the currency prevalence accuracy or quality of information that the User receives or obtains through the App Responsibility for using or relying on information received or obtained by the User through the services of the Masarrah App rests entirely with that User within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
11 The Masarrah App cannot confirm that every User of the App is actually the person they claim to be Each party to the Agreement must verify the identity of the other party in the event of direct dealings between them within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
12 We may at any time amend suspend or discontinue the services of the Masarrah App without sending you notice We may also suspend your use of our services if you violate these terms and provisions or misuse these services in our opinion within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
13 The Masarrah App its officers and employees shall not be legally liable to you or to any other party for any direct or indirect loss or any other cost that may arise from or in connection with the implementation of the Terms of Use Agreement or the provision of our services within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
14 The User shall protect the Masarrah App and its employees defend them and compensate them for any losses arising from any lawsuit or claim relating to the App or resulting from an act or omission by the User or the User representatives or agents within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
15 Without prejudice to its other rights the Masarrah App has the right to suspend or cancel your membership or access to the App at any time without notice and for any reason without limitation and may terminate this Agreement within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
16 The App does not guarantee that the services or any part of them will operate on all mobile devices As for devices on which the App operates delays or faults may occur due to an internet network issue Accordingly you release us from liability for all of that within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman
Twentieth Government Taxes
The parties to this Agreement shall pay the taxes imposed on them under the laws applicable in the Sultanate of Oman The App shall not be obligated to pay any taxes or governmental fees on behalf of any of its Users The App may suspend the membership of any User block access to the App or suspend the User activity or transactions if the User breaches this obligation
Twenty First Assignment of Rights and Obligations
1 The Masarrah App may assign all of its rights and obligations under this Agreement to a third party without requiring the approval of any App User The User shall perform all obligations under this Agreement towards the assignee once notified of the assignment and the assignee may take all legal measures against any party who fails to perform its obligations under this Agreement
2 The User may not assign any rights or obligations under this Agreement or arising as a legal effect thereof except after obtaining the App written approval Any assignment of rights or obligations without the App approval shall be void
Twenty Second Amendments
1 The Masarrah App may change the terms and conditions and Privacy Policy at any time it deems appropriate and for any reason The User must review such amendments before continuing to use the App We will notify the User by appropriate means and we will update the Last Updated date at the top of this document
2 Your continued use of the App after any updates to the terms and conditions and Privacy Policy whether by addition deletion or amendment shall constitute your express acceptance of such updates
3 We may at any time make any amendments or improvements we deem necessary to the App and its services to increase their effectiveness The User shall comply with any directions or instructions given by the App in this regard This type of amendment shall not require any notices or notifications to the User
4 The Masarrah App may change current and future fee subscription and commission plans without requiring the approval of any App User New fee plans shall apply directly from the date they are changed by the App
Twenty Third Termination of the Agreement
The Agreement shall be deemed terminated automatically without the need for notice or judicial procedures in any of the following cases if it is established that you have breached any paragraph or clause of this Agreement above while preserving all our rights to claim compensation for resulting damages if you assign the account or sublease it without our approval if the User fails to fulfill any obligations stipulated in this Agreement without taking serious measures to remedy such breach while preserving our right to claim compensation where applicable if we are unable to verify any information you provided to us if we determine at any time that your activities may expose you or other Users to legal disputes if the App activity ceases or if the activity of the persons responsible for managing the App ceases
Twenty Fourth Applicable Law and Competent Courts
1 This Agreement shall be governed by the laws regulations and decisions applicable and in force within the Sultanate of Oman
2 The courts within the Sultanate of Oman shall have jurisdiction over any dispute that may arise from the interpretation or implementation of the provisions of this Agreement and the Muscat Court of First Instance shall be competent to hear such dispute
3 If any provision of this Agreement becomes invalid unlawful or unenforceable the legality and enforceability of the remaining provisions shall not be affected in any manner by such provision
Twenty Fifth Communications and Notices
1 You acknowledge and agree that we may contact you by phone or electronically through the phone number email address or other means of communication Such communications shall be official between the App on the one hand and the Users on the other
2 You acknowledge and agree that telephone and electronic communications between you and the App shall replace any written notices or notices through official authorities and telephone and electronic communications and notices shall remain the means applicable between the parties
3 You acknowledge and agree that we use the contact data you provided to promote our services User data shall not be used for direct marketing purposes except as permitted by applicable laws and in a manner that allows the User to unsubscribe whenever possible We may send you updates about our services features and new offers that we believe may interest you
4 Any legal notices alerts or notifications you wish to send to the Masarrah App must be sent through the means specified inside the App Any notices sent outside the App shall not be recognized
5 Any legal notices alerts or notifications that the Masarrah App wishes to send to you shall be made either by posting them on the App or by sending them to you via the phone number or email address you provided during registration or any other contact details belonging to you You shall be deemed to have knowledge of the notice once it is posted on the App or from the time the message is sent to you
Twenty Sixth Language
In the event of any conflict between the Arabic text and the translated text of this Agreement the Arabic text shall prevail
